CleanGo Terms of Service

Introduction
Welcome to CleanGo (hereinafter referred to as "the App"). These Terms of Service constitute a legal agreement between you and EnerKit Pte. Ltd. (hereinafter referred to as "We").
Important Notice: Downloading or using this App indicates your agreement to be bound by this Agreement. If you do not agree, please do not use it.
1. License Grant and Use
1.1 License Model (Freemium)
CleanGo adopts a "Freemium" model:
- Free Version: Free download, access to basic scanning and preview features.
- Pro Version (Subscription): Paid unlock for core operations (e.g., one-tap cleaning, advanced compression).
1.2 Rights Granted
We grant you a limited, non-exclusive, non-transferable license for personal, non-commercial use only.
1.3 Use Restrictions
You must NOT engage in the following activities:
- ❌ Use this App for any commercial purpose or illegal activity.
- ❌ Reverse engineer, decompile, or modify the App (see Section 8.3 for detailed restrictions).
- ❌ Remove or modify any copyright, trademark, or other proprietary notices.
- ❌ Rent, lend, resell, or distribute the App to third parties.
1.4 Termination
If you violate these terms, we have the right to terminate your license immediately. You may also terminate the agreement at any time by deleting the App and canceling your subscription. Upon termination, your Pro benefits will expire, and refunds are generally not provided.
2. App Functionality Description
CleanGo is a photo cleaning and management tool that primarily offers the following features (availability depends on your subscription status):
- Similar Photo Recognition: Identifies visually similar photos using image analysis technology.
- Blurry Photo Detection: Evaluates photo clarity to help identify blurry photos.
- Media Organization: Automatically categorizes videos, screenshots, and Live Photos.
- Storage Statistics: Calculates reclaimable device storage space.
- Batch Deletion: Helps you quickly delete unwanted photos and videos.
3. Subscription Services
3.1 Subscription Plans
We offer weekly, annual, and other plans. Specific pricing is as displayed on the App Store.
3.2 Automatic Renewal
- Billing: Payment charged to iTunes Account at confirmation of purchase.
- Renewal: Automatically renews within 24 hours prior to the end of the current period unless turned off.
- Management: You can manage subscriptions in your Apple ID Settings.
3.3 Refund Policy
⚠️ Important: All purchase transactions are processed and managed by Apple Inc., and the refund policy follows Apple's standard terms and conditions.
3.3.1 Apple Refund Policy
As a subscription service purchased through the App Store, the following rules apply:
- You may request a refund within a specified period after purchase (typically 14 days, depending on your region's laws)
- Refund requests must be submitted through Apple support channels, not directly to us
- Apple will independently decide whether to approve your refund request based on its refund policy
- Apple has the final decision authority; we cannot intervene or overturn Apple's refund decisions
3.3.2 How to Request a Refund
Please follow these steps to request a refund from Apple:
Method 1: Via Apple Website
- Visit reportaproblem.apple.com
- Sign in with your Apple ID
- Locate the CleanGo subscription purchase record
- Click the "Report a Problem" button
- Select "I'd like to request a refund"
- Choose a refund reason and submit the request
- Wait for Apple's review (typically responds within 48 hours)
Method 2: Contact Apple Support
- Call Apple Customer Support hotline (visit support.apple.com/contact to find your region's number)
- Or submit an online support request via the Apple Support app
3.3.3 Our Position
EnerKit Pte. Ltd.'s policy regarding refunds:
- Respect Apple's Decision: We fully respect and comply with Apple's refund decisions and will not challenge or appeal them.
- Immediate Access Termination: If your refund request is approved by Apple, your Pro subscription privileges will be immediately terminated, and you will no longer be able to use paid features.
- No Partial Refunds: We do not offer pro-rated partial refunds (e.g., half refund after using 6 months of an annual subscription).
- No Direct Refunds: Since transactions are processed by Apple, we cannot directly refund you.
3.3.4 Free Trial Period Special Terms
If your subscription includes a free trial period:
- You can cancel your subscription at least 24 hours before the trial period ends and will not be charged
- Cancellation method: iOS Settings > Apple ID > Subscriptions > CleanGo > Cancel Subscription
- If the trial period has ended and you've been charged, please follow the above method to request a refund from Apple
- Apple may have stricter review standards for refund requests after the trial period
3.3.5 Special Circumstances
If you encounter the following situations, please contact us first:
- Duplicate Charges: If you believe you were incorrectly charged multiple times, send proof of charges to cleango_ios@support.enerkit.life with subject: "Duplicate Charge Complaint"
- Technical Issues: If app malfunction prevents you from using paid features, contact our technical support first; we may provide compensation or extend your subscription
- Accidental Purchase: If you or your family member accidentally purchased a subscription, contact Apple support as soon as possible to explain the situation
While we cannot directly process refunds, we may provide alternative compensation for confirmed technical issues (subject to individual case evaluation):
- Extension of current subscription period (if service was unavailable)
- Compensation access to Pro features (for documented bugs)
- Discount codes for future purchases (for inconvenience caused by technical failures)
Note: Such compensation is provided only for verifiable technical failures on our end, not for change of mind or dissatisfaction with features.
3.3.6 Non-Refundable Situations
Please note that the following situations typically do NOT qualify for refunds:
- You have extensively used Pro features (e.g., deleted thousands of photos)
- You simply "changed your mind" or "no longer need it" (outside trial period)
- Misunderstandings resulting from failure to read feature descriptions
- Your device is incompatible with certain features (this information is stated on the App Store page)
- The subscription period is nearing its end
3.3.7 Reference Links
Note: Uninstalling the app does NOT automatically cancel your subscription. You must actively cancel the subscription through your Apple ID settings, or you will continue to be charged.
4. Privacy and Data Security
Your privacy is crucial. Using this App implies your agreement to our Privacy Policy.
Core Commitments:
- Local Processing: Photos/videos are never uploaded.
- Technical Isolation: Third-party SDKs cannot access your photos.
5. User Responsibilities and Obligations
5.1 Independent Judgment
When using this App, you assume the following responsibilities:
- Decision to Clean: The App only provides organization suggestions (e.g., "this is a blurry photo"). Whether to delete is entirely your decision. You should carefully confirm before clicking delete.
- Backup Obligation: Although there is an iOS "Recently Deleted" album buffer, we strongly recommend backing up important photos before performing large-scale batch deletions.
6. Disclaimer
The App is provided "AS IS", without any form of warranty.
6.1 Functional Accuracy
- Blur Detection: Clarity judgment is subjective; algorithm results are for reference only and may differ from your visual perception.
- Similar Photos: Recognition is based on image algorithms and may have False Positives.
- Storage Calculation: Displayed freed space is an estimate and may differ slightly from actual system freed space.
7. Limitation of Liability
Photo Deletion Warning:
Although deleted photos go to "Recently Deleted" for 30 days, you must still operate with caution. We are not liable for any data loss (including accidental photo deletion).
To the maximum extent permitted by law, EnerKit Pte. Ltd. is not liable for any indirect, consequential, or punitive damages.
In any event, our total liability shall not exceed the greater of: (A) the amount you paid us in the past 6 months; or (B) 100 USD.
8. Intellectual Property
8.1 Ownership Statement
All intellectual property rights in the CleanGo app and all its components (collectively "App Content") are owned by EnerKit Pte. Ltd. or its licensors and are protected by international copyright, trademark, and other intellectual property laws.
App Content includes but is not limited to:
- Software source code, object code, algorithms, and architecture
- User interface design, graphics, icons, buttons, animations
- Text content, copy, translations
- Trademarks, service marks, logos, brand names
- Audio, visual effects, color schemes
- Documentation, tutorials, help content
8.2 Trademarks
The "CleanGo" name, CleanGo logo, and other related marks are trademarks or registered trademarks (in applicable jurisdictions) of EnerKit Pte. Ltd.
Prohibited Actions:
- Without our prior written permission, you may not use these trademarks on any goods, services, advertising, promotional materials, or other contexts
- You may not register domain names, social media accounts, or trademarks similar to or likely to cause confusion with our trademarks
- You may not use our trademarks in a manner that implies our sponsorship, endorsement, or affiliation with your products/services
8.3 License Restrictions
Under the limited license granted to you in Section 1.2, you are expressly prohibited from:
Strictly Prohibited:
- Reverse Engineering: Decompiling, disassembling, reverse engineering, or otherwise attempting to discover the source code, proprietary algorithms, or underlying ideas of the app
- Modification & Derivative Works: Modifying, adapting, translating, or creating derivative works based on the app
- Copying & Distribution: Copying, distributing, publicly displaying, publicly performing, or publishing the app or any part thereof
- Removing Marks: Removing, obscuring, or altering any copyright notices, trademark marks, or other proprietary rights marks
- Commercial Exploitation: Using the app for any commercial purpose, or renting, leasing, lending, selling, sublicensing, or distributing the app to third parties
- Circumventing Protections: Circumventing, disabling, or interfering with any security features or technological protection measures of the app
Violating these restrictions may result in:
- Immediate termination of your license and account
- Civil and criminal legal consequences
- Requirement to compensate us for losses and legal fees
8.4 User-Generated Content
8.4.1 Your Photos and Videos
You Retain All Rights: All rights, title, and interest in and to the photos and videos you access, scan, or process through the app remain yours.
Our Position:
- We do NOT claim any ownership, license rights, or intellectual property in your personal content
- Your photos and videos are never uploaded to our servers, so we cannot even access them
- The app only processes your content locally on your device; no rights transfer is involved
8.4.2 Feedback & Suggestions
If you provide us with any feedback, suggestions, ideas, improvement requests, or other information (collectively "Feedback"), you agree that:
- The Feedback is voluntarily provided and is not confidential or proprietary
- We may freely use the Feedback without any payment or obligation to you
- We may use the Feedback for any purpose, including improvement, marketing, developing new features, or creating derivative works
- You waive any moral rights (such as attribution rights) in the Feedback
8.5 Third-Party Content & Open Source Licenses
8.5.1 Third-Party SDKs
The app integrates third-party Software Development Kits (SDKs), including:
- AppsFlyer SDK: Developed by AppsFlyer Ltd. for mobile attribution
- Facebook SDK: Developed by Meta Platforms, Inc. for ad analytics
These SDKs are subject to their respective vendors' license agreements and are not covered by the license granted in these Terms.
8.5.2 Apple Intellectual Property
iPhone, iOS, App Store, Apple ID, Face ID, Touch ID, etc. are trademarks of Apple Inc. in the United States and other countries. We make no claim to these trademarks; their mention is solely for describing compatibility or functionality.
9. Dispute Resolution
9.1 Governing Law
The interpretation, validity, and performance of this Agreement shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of laws principles.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall NOT apply to this Agreement.
9.2 Jurisdiction & Courts
For any dispute, claim, or action arising out of or relating to this Agreement or your use of the App (including but not limited to contract, tort, fraud, misrepresentation), both parties irrevocably agree that:
- Exclusive Jurisdiction: The courts of Singapore have exclusive jurisdiction
- Venue: Any legal action must be brought in Singapore
- Waiver of Objections: You waive any objections regarding inconvenient forum (forum non conveniens) or lack of personal jurisdiction
Exception: Intellectual property infringement claims or emergency injunctive relief may be brought in any court with jurisdiction.
9.3 Class Action Waiver
To the maximum extent permitted by law, you agree that:
- Any dispute must be resolved on an individual basis, not as part of a class action, class arbitration, or representative action
- You waive your right to be a class action plaintiff or class member
- You waive your right to act as a private attorney general
- The arbitrator or court has no authority to consolidate more than one person's claims or preside over any form of representative proceeding
9.4 Statute of Limitations
Any claim or action against us must be brought within 1 year after the cause of action arises, or it will be permanently barred.
For example:
- If you purchased a subscription on June 1, 2025, you must file any related claim by June 1, 2026
- The limitation period runs from the date you knew or should have known of the claim
This is shorter than the statutory limitation period in some jurisdictions, but is effective to the extent permitted by law.
9.5 Informal Dispute Resolution (Encouraged)
Before filing any formal lawsuit or arbitration, we strongly encourage you to contact us first to attempt a friendly resolution:

- ⏱️ Waiting Period: Give us 30 days to respond and attempt resolution
Many disputes can be resolved quickly through communication, without expensive and time-consuming legal proceedings.
9.6 Apple as Third-Party Beneficiary
You acknowledge and agree that:
Apple Inc. and its subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.
This means:
- Apple can directly enforce the terms of this Agreement against you
- Any disputes between you and Apple should be resolved according to Apple's EULA (End User License Agreement)
- This Agreement does not affect any other agreement that may exist between Apple and you
9.7 Region-Specific Provisions
9.7.1 EU Users
If you are located in the EU/EEA:
- The above dispute resolution provisions do NOT affect your mandatory rights under EU consumer protection laws
- If required by EU law, you may bring actions in the courts of your country of residence
- You may use the European Commission's Online Dispute Resolution (ODR) platform
9.7.2 California Users
California Civil Code Section 1789.3 requires us to inform you that:
- You may file a complaint with the California Department of Consumer Affairs

10. Indemnification
You agree to indemnify and hold us harmless from any claims arising out of your violation of this Agreement or infringement of third-party rights.
11. General Terms
- Severability: If any provision is invalid, it does not affect the validity of other provisions.
- Entire Agreement: This Agreement constitutes the entire agreement between the parties regarding the App.
12. Agreement Confirmation
By downloading, installing, or using CleanGo App, you confirm that:
- You have carefully read and understood these Terms of Service
- You agree to be bound by all terms of this Agreement
- You have read and understood our Privacy Policy
- You have the legal capacity to agree to this Agreement
