Terms of Service

These Terms of Service (the "Terms") govern your use of the WellKeeper mobile application (the "App"), provided by Enerkit Life ("Enerkit", "we", "us"). By downloading or using the App, you agree to these Terms.

1. Eligibility (13+)

The App is not directed to children under 13. By using the App, you represent that you are at least 13 years old.

The App is for informational purposes only. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. Never disregard professional medical advice because of something you have read in the App. If you have a medical emergency, call emergency services immediately.

2. Medical Disclaimer Details

Not a Substitute: The App's insights are based on algorithms and general data, which may not apply to your specific condition.
Camera Measurements: Heart rate measurements via camera are estimates based on blood flow changes (PPG). They can be affected by lighting, movement, and skin temperature. Do not use for clinical diagnosis.

3. Your Responsibilities

Permissions: You are responsible for managing iOS permissions (Apple Health, Camera).
Accuracy: You acknowledge that App data depends on the quality of inputs from HealthKit and your device sensors.
Lawful Use: You agree not to use the App for any illegal purpose.

4. Privacy

Your use of the App is also governed by our Privacy Policy. We are committed to a "Local First" architecture where your health data stays on your device.

4.1 Data Retention and Deletion

All your health data is stored locally on your device. While the App can access your health data on your device (with your authorization), we do not upload, store, or access your data from any server. Your data never leaves your device. If you wish to delete your data:

Uninstall the App: This will remove all app-specific data from your device.
Reset in Settings: You can clear all local data in the app's Settings page.
Health Data: Data stored in Apple Health remains there until you manually delete it via the Health app.

5. License and Restrictions

Enerkit grants you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use.

You agree not to:

Reverse engineer, decompile, or disassemble the App.
Use the App to build a competing product or service.
Bypass any security features of the App.

6. Intellectual Property

The App, including its design, code, and content, is owned by Enerkit and protected by copyright laws.

7. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENERKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms.
