Terms of Service

These Terms of Service (the "Terms") govern your use of the WellKeeper mobile application (the "App"), provided by Enerkit Life ("Enerkit", "we", "us"). By downloading, accessing, or using the App, you agree to these Terms.

1. Eligibility (13+)

The App is not directed to children under 13. By using the App, you represent that you are at least 13 years old.

2. Medical Disclaimer Details

• Not a Substitute: Insights are algorithmic and may not fit your specific condition.
• Camera Measurement Limits: Camera-based heart-rate estimates (PPG) are affected by lighting, motion, and temperature, and are not for clinical diagnosis.

3. Your Responsibilities

• Permissions: You are responsible for managing iOS permissions (Health, Camera, Tracking).
• Accurate Inputs: Results depend on the quality and availability of device and HealthKit data.
• Lawful Use: You agree not to use the App for unlawful activities.

4. Privacy and Data Handling

Your use of the App is also governed by our Privacy Policy. HealthKit data and camera frames used for heart-rate measurement are processed locally for core health features. Certain operational, attribution, and subscription-validation metadata may be processed on secure servers as described in the Privacy Policy.

4.1 Data Deletion Controls

• Uninstall: Removing the App deletes app-local data from your device.
• In-App Reset: You can clear local app data from Settings where available.
• Apple Health: Data stored in Apple Health remains there until removed in the Health app.

5. Subscriptions, Billing, and Trials

Some features require an auto-renewable subscription purchased through Apple's in-app purchase system.

• Billing: Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-Renewal: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
• Renewal Charge: Your account is charged for renewal within 24 hours before the end of the current period.
• Manage or Cancel: You can manage and cancel subscriptions in App Store account settings after purchase.
• Free Trial: If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Unless canceled, trial subscriptions convert to paid subscriptions at the end of the trial period.
• Price Changes: Subscription prices may change in accordance with Apple's rules and notice mechanisms.
• Refunds: Refund requests are handled by Apple according to Apple's policies.

6. License and Restrictions

Enerkit grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial use.

You agree not to:

• Reverse engineer, decompile, or disassemble the App.
• Use the App to build a competing product or service.
• Bypass or interfere with security or access controls.

7. Intellectual Property

The App, including its software, design, trademarks, and content, is owned by Enerkit or its licensors and protected by applicable laws.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENERKIT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE APP.

10. Changes to Terms

We may update these Terms from time to time. The updated Terms become effective when posted. Continued use of the App after updates means you accept the revised Terms.
